Read Ganesh Realty's terms of service — rules for using our property platform, listing guidelines, and legal terms.

1. Acceptance of Terms
By accessing or using Ganesh Realty ("the Platform", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.
2. Eligibility
- You must be at least 18 years old
- You must be capable of entering into a legally binding contract under Indian Contract Act, 1872
- You must not be barred from using the services under any applicable law
3. Account Registration
- You must provide accurate, current, and complete information
- You are responsible for maintaining confidentiality of your account
- You are responsible for all activities under your account
- Notify us immediately of unauthorized access
- We reserve the right to suspend or terminate accounts violating these Terms
4. Platform Purpose
Ganesh Realty is a marketplace that connects:
- Property buyers and sellers
- Tenants and landlords
- Lessees and lessors
- PG seekers and PG owners
- Hotel guests and hotel owners
We are NOT a party to any transaction between users. We do not guarantee the accuracy of listings or the completion of any deal.
5. Listing Rules
By listing a property, you agree that:
- ✅ You have legal authority to list the property
- ✅ All details are accurate and truthful
- ✅ Photos are of the actual property
- ✅ Price and specifications are correct
- ❌ No duplicate listings for the same property
- ❌ No fake, misleading, or scam listings
- ❌ No listings for illegal or prohibited properties
- ❌ No listings with offensive content
Violations result in immediate removal and possible account ban.
6. User Conduct
You agree NOT to:
- Harass, abuse, or harm other users
- Post discriminatory, hateful, or obscene content
- Impersonate another person or entity
- Use automated bots, scrapers, or crawlers
- Attempt to hack, overload, or disrupt the Platform
- Collect other users' data without permission
- Violate any applicable law
- Post spam or unsolicited promotions
7. Content Ownership
- You retain ownership of content you upload
- You grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content on the Platform
- You confirm you have rights to all content you upload
- We may remove content violating these Terms or applicable law
8. Fees and Payments
- Free Listings: Basic listings are free
- Premium Services: Paid features like Featured, Premium Boost, Hotel Booking may involve fees
- Payment Processing: Handled by third-party gateways (Razorpay, PayU, etc.)
- Refunds: Governed by our Refund Policy
- Taxes: You are responsible for applicable taxes
9. Brokerage Disclaimer
Ganesh Realty is NOT a broker or real estate agent. We do not charge brokerage on property transactions. Users who are brokers must disclose their brokerage charges transparently.
10. Verification Disclaimer
While we verify listings to the best of our ability:
- We do not guarantee accuracy of any listing
- We do not verify legal title, ownership, or encumbrances
- We recommend independent legal verification before any transaction
- We are not liable for any losses from fraudulent listings
11. Limitation of Liability
To the maximum extent permitted by law:
- Ganesh Realty is provided "as is" without warranties
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed ₹10,000 or the fees paid by you, whichever is lower
- We are not responsible for third-party content, links, or services
12. Indemnification
You agree to indemnify and hold harmless Ganesh Realty, its directors, employees, and agents from any claims, losses, or damages arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
13. Account Termination
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- Required by law
- Prolonged inactivity (12+ months)
You may delete your account anytime from Dashboard → Settings.
14. Intellectual Property
All Platform content including logo, design, code, and text (excluding user-generated content) is owned by Ganesh Realty and protected under Indian Copyright Act, 1957.
15. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Udaipur, Rajasthan.
16. Dispute Resolution
For any dispute:
- Step 1: Contact us at legal@ganeshrealty.in
- Step 2: Good-faith negotiation for 30 days
- Step 3: Mediation or arbitration if unresolved
17. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be notified.
18. Severability
If any provision is found invalid, the remaining provisions remain in full force.
19. Entire Agreement
These Terms, along with Privacy Policy and Refund Policy, constitute the entire agreement between you and Ganesh Realty.
